I601A Form Is Different Than The I601 Form

The I601A form is different than the form used for I601 waivers. When you are preparing your I601A waiver package, make sure that you include the correct form for the type of waiver that you need. If you submit the wrong form, your package will not be approved and you could lose your application fee.

Extreme Hardship Standard Is The Same for I601A Waivers and I601 Waivers

Also don’t forget that the legal standard for getting and I601A waiver is the same as the standard for I601 hardship waivers. The forms are different and the application process is different, but you still need to show the same level of hardship to get your waiver. The I601A waiver process will allow you to minimize the time you are separated from your family, but it won’t make it easier to meet the extreme hardship standard.

How Much Does The I601A Form Cost?

The I601A form is free and you should never pay someone just for a copy of the form. When you finish preparing your package, you’ll need to include a government filing fee of $585 plus $85 for the biometrics fee for a total of $670. If you are 79 years of age or older, you won’t need to pay the biometrics fee. There is no fee waiver available for the filing fee. If you don’t have the filing fee, you’ll need to wait to file your I601A waiver package until you are able to include the fee. Please note that this fee is paid to the government.

Do I Need A Lawyer To Help Me Complete the I601A Form?

There is no requirement to hire a lawyer to help you apply for a waiver. The I601A form itself likely will not be very difficult to complete and you may not need a lawyer just to fill in the form. But keep in mind that the most important part of your package is the evidence of extreme hardship that you include. Many people will find the assistance of an immigration lawyer to be very helpful in identifying their strongest hardship factors, identifying the best evidence to support their hardship factors, preparing your hardship letters and preparing a legal letter to include with your package.

I strongly encourage you to learn as much as you can about the I601A provisional waiver process before you talk to a lawyer.
